1. Acceptance of Terms
By accessing or using the Trackli platform (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and Trackli.
2. Description of Service
Trackli provides affiliate program management tools including referral tracking, conversion attribution, commission calculation, affiliate management, analytics dashboards, and API access. The Service is provided on a subscription basis with free and paid tiers based on the number of referred customers per month.
3. Account Registration
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and API keys. You agree to provide accurate and complete information during registration and to keep your account information up to date. You must notify us immediately of any unauthorized use of your account.
4. Subscription and Billing
Paid plans are billed on a monthly or annual basis depending on your selection. You authorize us to charge your payment method for recurring subscription fees. If you exceed your plan’s referred customer limit, we will automatically upgrade you to the next tier to ensure no tracking data is lost. You will be notified before any billing change takes effect. You may cancel your subscription at any time, and your access will continue until the end of the current billing period. Refunds are not provided for partial billing periods.
5. Acceptable Use
You agree not to use the Service for any unlawful purpose; to violate any applicable laws, regulations, or third-party rights; to transmit harmful code, malware, or viruses; to interfere with the operation, security, or integrity of the Service; to use the Service to facilitate fraudulent affiliate activity; or to attempt to gain unauthorized access to any part of the Service.
6. API Usage
Access to the Trackli API is subject to rate limits that vary by plan. You agree not to exceed these limits or use the API in a manner that could degrade the performance of the Service for other users. We reserve the right to throttle or suspend API access if usage patterns indicate abuse.
7. Intellectual Property
The Service, including its design, code, documentation, and branding, is owned by Trackli and protected by applicable intellectual property laws. You retain all rights to the data you submit through the Service. We do not claim ownership of your affiliate program data, analytics, or any content you create using the platform.
8. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. You acknowledge that you have read and understood our Privacy Policy and consent to the collection and use of your data as described therein.
9. Limitation of Liability
The Service is provided “as is” and “as available” without warranty of any kind, express or implied. In no event shall Trackli, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of revenue, data, or business opportunities.
10. Indemnification
You agree to indemnify and hold harmless Trackli and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorney’s fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
11. Termination
We may terminate or suspend your account at any time for violation of these Terms or for any other reason at our sole discretion, with or without notice. Upon termination, your right to use the Service will immediately cease. You may request export of your data within 30 days of termination.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the “Last updated” date. Your continued use of the Service after any modification constitutes acceptance of the modified Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
